You may be = able to save=20 money by treating a hazardous waste onsite.  Really.  In 2002 the=20 California=20 hazardous waste laws changed to allow for onsite = neutralization of=20 certain biotechnology and pharmaceutical acidic and caustic = wastes=20 without having to first obtain a permit or other = authorization.  This is a big deal = because=20 as many of you know hazardous waste treatment, especially in = California, usually = requires=20 extensive filing of paper work, payment of fees, etc.  To be eligible for = this=20 exempt treatment, the waste water must be less than 10 = percent by=20 weight acid or caustic (may exceed this percent in some=20 circumstances) and hazardous solely due to the acidic or = caustic=20 nature of the waste.  =

Some waste = streams that=20 may be eligible include: =20

-  CIP waste waters=20

-  Dissolution waste=20 waters

-  Other acidic and = caustic=20 waste waters

Identifying=20 Chemicals =96 Common Naming Systems and Molecular and = Structural=20 Formulas=20

As EH&S=20 professionals, we run across hundreds of different chemicals = on a=20 weekly if not daily basis. =20 It is part of our job to identify chemicals and = determine the=20 rules and regulations which pertain to their safe use and=20 handling.  = There are a=20 number of systems for identifying chemicals.   The most = common method=20 of identifying a chemical is by its chemical=20 name.  = The=20 most commonly used naming system is that developed by the International=20 Union=20 of Pure and Applied Chemistry (IUPAC).  Under the IUPAC = system, Cu2O=20 is named Copper (I) oxide. =20 Note that the oxidation state of copper is in the=20 parenthesis.  = [For=20 health and safety professional, oxidation state can make a = big=20 difference on whether a chemical is hazardous.  For example, = Chromium (III)=20 compounds are generally significantly less hazardous than = Chromium=20 (VI) compounds]).  = Under=20 an older naming system, Cu2O is named Cuprous oxide.  Another way to = identify a=20 chemical is by its Chemical=20 Abstracts Service (CAS) number, which specifies a = unique=20 number for each chemical (e.g., CAS number for acetone is=20 67-64-1).  A = chemical=20 can also be identified by its molecular=20 formula.  = For=20 example, the molecular formula of methane is CH4.   The = molecular formula=20 tells us the atoms which are found in the actual = molecule.  For methane, it = tells us=20 that there is one carbon and four hydrogen atoms in the=20 molecule.  = Interesting,=20 but does the molecular formula tell us how the atoms are = connected=20 (i.e., bonded) to each other? =20 No.  = Think of all=20 the ways you can connect these five atoms?   A structural=20 formula tells us how the atoms are all = connected.  For methane, the = structure=20 formula is given below. =20

Bloodborne=20 Pathogens Programs =96 Don=92t Get Stuck by an Incomplete=20 Program=20

I recently = attended=20 a Cal/OSHA meeting on the topic of establishing regulations = to=20 control airborne exposure to pathogens.  After the = discussion, I=20 asked two of the inspectors what violations of the BBP = Standards=20 they most commonly find during their inspections.  And this is what = they=20 said:

 -  No written = Bloodborne=20 Pathogens Plan.  = The BBP=20 must be written and accessible to employees.  Here is a = link to the=20 BBP regulations.

-  Training is not = occurring=20 annually.  = Employees=20 with occupational exposure must be retrained annually and = there must=20 be an interactive components to the training - video alone = is=20 probably not sufficient.

-  Employees are not = involved=20 in reviewing and updating the plan. =20

-  Used sharps are = left=20 unattended. =20

Hazardous=20 Waste Definition =96 RCRA and = Non-RCRA=20

I am assuming = that most=20 of you have a good idea what constitutes a hazardous = waste.  But every so often = it is a=20 good idea to refresh our knowledge on the topic, since = hazardous=20 waste regulations can be complex.  Doing business in=20 California=20 subjects us to two categories of hazardous wastes:  RCRA=20 hazardous wastes (i.e., those hazardous wastes = regulated=20 nation-wide by the EPA) and non-RCRA=20 hazardous wastes (i.e., those hazardous wastes = regulated=20 only in California=20 by the Cal/EPA (or more often than not, a local agency known = as a=20 CUPA).

Technically, the=20 first step in determining whether a material is a hazardous = waste is=20 to determine if it has been excluded from the legal = definition of=20 hazardous waste.  = To=20 promote recycling and lessen the overall burden to the = public and=20 private sectors, certain wastes, such as household hazardous = waste,=20 wastes used as feedstock, and many others have been excluded = from=20 the definition of hazardous waste. =20

 
If you have determined = that=20 your waste is not excluded, the next step is to determine if = it is=20 meets the definition of a hazardous waste.  Let us start with = RCRA=20 hazardous wastes.  = In=20 general, RCRA hazardous wastes include wastes which are listed=20 (because they are generally understood to be hazardous to = human=20 health or the environment) and also wastes which exhibit a = hazardous=20 characteristic. =20

Listed=20 RCRA hazardous wastes include the = following=20 four categories of wastes:  =20

- F listed = wastes =96=20 wastes from certain sources, such as solvents. =20

- K listed = wastes =96=20 wastes from specific sources, such as distillation bottoms = from the=20 production of aniline

- P listed = wastes =96=20 wastes from expired chemicals or wastes in which the active=20 ingredient is acutely toxic

- U listed = wastes-  wastes from = expired=20 chemicals or wastes in which the active ingredient is=20 toxic

Characteristics=20 of a RCRA hazardous waste include: =

- Ignitability=20 (flashpoint < 140F).  For example, paint = solvents. =20

- Corrosivity=20 (liquid or gaseous acids and caustic materials.  pH < =3D2 or=20 >=3D12.5).  = For=20 example, battery acid or drain certain decloggers.  [Note: non-RCRA = includes=20 solids as well as liquids]

- Reactivity=20 (chemicals which react violently with water, = explosives,=20 and chemicals which emits toxic or flammable gas if mixed = with=20 water, contain sulfides or cyanides).  For example, = cyanide plating=20 waste.

- Toxicity=20 (a waste which fails the Toxicity Characteristic Leaching = Procedure=20 (TCLP) test for any of about 40 organic and inorganic=20 chemicals).  = For=20 example, paint wastes which contain certain toxic metals, = such as=20 lead.

Non-RCRA=20 Hazardous Wastes

In=20 California, wastes may = be presumed=20 to be hazardous if they are one of approximately 800 pure = chemicals=20 or classes of chemicals found in California Code of = Regulations,=20 Title 22 Section 66261.126, Appendix X - List of Chemical = Names and=20 Common Names for Hazardous Wastes and Hazardous Materials. = Included=20 are pure chemicals or classes of compounds (such as silver=20 compounds) as well as types of materials (such as dyes and = fuel=20 waste).  The = burden lies=20 on the back of the waste generator to prove that the waste = is not=20 hazardous. =20

California=20 also has a broader definition of Toxicity.  For starters,=20 California=20 has its own leaching test, known as the Waste Extraction = Test (WET)=20 test which is different from the TCLP. =20 California=20 has set standards for Soluble Threshold Limit Concentration = (STLC)=20 and Total Threshold Limit Concentration (TTLC) for = approximately 20=20 inorganic and 18 organic chemicals or classes of = chemicals.  =20 California=20 has also set LD50 values for acute oral, acute dermal, and = acute=20 inhalation as well as an aquatic 96-hour LC50.  Having an LD50 or = LC50 below=20 one of these thresholds may mean that you have a non-RCRA = hazardous=20 waste.

Hazardous=20 Waste Requirements

Once you have = determined=20 that you generate a RCRA or non-RCRA hazardous waste, you = are=20 subject to a multitude of regulations that relate to its = handling=20 and management.  = Some of=20 the requirements that may apply,=20 include::

-  Accumulation time=20 limits

- =20 Inspections

-  Shipping documents = (Manifest)

-  Contingency=20 planning

-  Biennial=20 reporting
